How the Marriage Allowance Tax Benefit Works

The Marriage Allowance tax benefit lets one partner transfer £1,260 of their unused Personal Allowance to their spouse or civil partner. The Personal Allowance is the amount you can earn tax-free — typically £12,570. This transfer can reduce the higher-earning partner’s tax bill by up to £252 annually.

To qualify for the Marriage Allowance tax benefit, the lower-earning partner’s income must be below their Personal Allowance. Although the transfer might create a small tax liability for the lower earner, the overall household usually ends up saving more.

Example:

  • One partner earns £11,500 — no tax paid.
  • The other earns £20,000 – pays tax on £7,430.
  • Allow the allowance transfer, the higher earner’s taxable income drops to £6,360.
  • The couple saves £214 in tax.

Who Can Claim the Marriage Allowance Tax Benefit?

You can apply if:

  • You’re married or in a civil partnership.
  • Your income is below your Personal Allowance.
  • Your partner pays basic rate Income Tax (typically between £12,571 and £50,270).

Unmarried couples are not eligible. In Scotland, additional tax band rules apply. You may also qualify if you receive a pension or live abroad but still have a UK Personal Allowance. Those born before 6 April 1935 may receive better savings through Married Couple’s Allowance — but you can’t claim both.

Backdating and Cancelling Your Claim

You can backdate your claim for the Marriage Allowance tax benefit as far back as 6 April 2021, if eligible. This allows for even greater savings across multiple tax years. If your partner has passed away since 5 April 2021, a claim may still be made.

Once claimed, the allowance automatically renews each year unless you cancel it — for example, due to income changes or separation.
